One of the reasons I hate the news media is that I have to read law blogs to piece together the narrative and get a sense of just how batshit insane these people are. Here's the breathtaking chronology:
1. Cheney's legal pitbull finds a low-level, clueless dipshit in the Justice Department's Office of Legal Counsel to declare all constitutional principles, legislation and international treaty relating to torture is null and void.
2. Relatively sane conservatives like Jack Goldsmith pull back on the reins, but is forced to leave before his head explodes. The Bushies make lemonade out of these lemons by convincing the press and punditocrisy that they've backed off the "if the president does it, it isn't illegal" position.":
3. Goldsmith's replacement is another clueless dipshit who decides to subject himself to waterboarding to determine if it's torture (can you imagine if he were in charge of the vice squad?). Naturally, he finds that it is. But under pressure he still signs off on a footnote that runs directly contrary to his conclusions (what, did Addington bite him in the nuts?). Once again the language of the footnote, pulled completely out of Addington's ample ass, attempts to invalidate centuries of legal precedent.
We see the same pattern in everything these assholes do. How many times was the Niger yellowcake forgeries knocked down by the sane, only to pop up again and again and again?
