"Law and order" is one of those perennial campaign slogans.
It's also a trademark of a long-running series on NBC, featuring Fred Thompson as New York District Attorney Arthur Branch for the last few years.
No one would deign to use Thompson's fictional pose in a serious capacity, would they?
Of course they would.

I wonder if NBC could make a case that this is trademark infringement? One of the standards for infringement is "likelihood of confusion;" I would think that the pairing of his image with the phrase "Law & Order" would be right up some corporate IP lawyer's alley.

I don't as much fault his campaign for doing that as I fault voters who get sucked into image/persona candidacies. Of course we're talking about the same base who thinks the "War on Terror" is like a TV "24" episode, so it goes with the territory.

Anyone out there with photoshop skills? Every time Fred is mentioned I get this hilarious vision of Big Fred's head attached to the Right Said Fred guy in that "I'm too sexy" video from a decade ago. I can hear Fred singing, "I'm too sexy for my party, I'm too sexy for debate, I'm so sexy it huuurts" and on and on. If only I had the skills for U-tube....
