David Massey, the Neighborhood Coordinator for the City of Knoxville, sends out an email newsletter every Friday with info on upcoming events, etc.
Here's an excerpt from today's newsletter (my bolding):
10. Convenience Voting Possible for City Elections This Year
The Convenience Voting issue is scheduled for a City Council workshop on May 14, and then will be on the agenda for the June 2 City Council meeting.
City Council will be asked to authorize the plan before the June 18 deadline for filing a petition to run for City Council this year. Once the plan is authorized, the Election Commission will vote whether or not to implement the plan.
If the plan is approved, there would be early voting as in the past. However, instead of 52 voting sites across the county, the number would be reduced to a handful of convenience voting centers - at least one for every 25,000 registered voters.
Polls would open 20 days before an election and stay open until 8:00 pm on Election Day. Voters would be able to vote at any point during that time frame. The plan would also allow voters to vote at any of the voting centers, not restricting individuals to a specific voting location.
This plan would not eliminate wards or precincts in Knox County, as they are considered to be vital components in the political process and are included in the legal descriptions of real property. However, by not requiring voters to vote at a precinct voting location, the Election Commission expects to save resources, while voters could save time and avoid confusion.
The new plan would also aid in diminishing the possibility of voting fraud. The voting centers would be linked to the central database -- instantly recording that a person has voted -- and preventing that individual from voting at multiple locations. Or will that be parsed also? Probably.
Each day is Election Day with convenience voting and convenience voting is the end of traditional voting and our traditional Election Day. It really is something the voters should decide, not City Council. It is a very bad idea with too many unintended consequences.
It might be better to say convenience voting is the effective end of precincts and wards just so as to not waste time with the literal interpretation of the word parsers. Seems like there is a Tom McAdams under every rock around here.
This reminds me a lot of Charter Amendment 3 that just squeaked by with a 1.5% margin of victory. We keep having to relearn what "unintended consequences" are.
Now that the people of Sequoyah Hills have learned they will be in the 9th District, they are mad as hell. The people in the 9th District are mad as hell. The people in North Farragut have learned they will be in the 6th District, they are mad as hell. No word on what the people in Karns think but they might be laughing their asses off at the Farragut folk.
Word is the people in Sequoyah Hills and Farragut want Charter Amendment 3 dead. This is pretty funny considering they voted it in. Some advice, think before you vote.
Convenience voting is another bad idea that should be the decision of the voters. But they wouldn't dare let that happen. The Knox County Republican Party has voted almost unanimously against convenience voting. Not much reporting about that.
Be sure to tune in Monday to the County Commission meeting as the Briggs coup makes its last stand.

Ironically I tried to warn everyone this would happen. You really screwed the pooch when you gave Charter Amendment 3 extra time.
Now the brutal gerrymandering battle that will ensue will make everyone cry, go crazy, or laugh. I am laughing my ass off. This is the perfect cluster f*ck. Now the people in Farragut and Sequoyah Hills are pissed. That's the problem with apathy. After you are screwed you find out.

Unintended Consequences
I don't think people really thought through the consequences of these amendments and that's why I bailed. For me, it wasn't that some of the ideas didn't have merit, it was the way they were being pushed through without proper consideration just to do it in time for the election, and my concerns about some of the funding and people involved.
I think many people who voted for Amendment 3 are gonna be wailing when they see the consequences.

With the low threshold to obtain signatures for Charter Amendments it is safe to say there will be more Charter Amendments.
The two that come to mind are Metro government and to abandon the current County Charter.
When you see that only Shelby County and Knox County have this never ending tug of war over Charter interpretations you have to ask yourself what good is the County Charter? If it cannot be fixed maybe it should be retired? It was supposed to give the people more autonomy. What happened was a war between dueling court house crowds.
Consolidated Government - Constitutional Process
Just as an FYI, the consolidation of city and county governments cannot be accomplished except by concurrent majorities voting for it (metro charter) both inside and outside of the corporate limits of the City of Knoxville. There is not even a possibility of a charter to vote for without a long process that would begin with appointees approved by from the City, Knox County, and from Farragut. They would prepare a charter to put on the ballot. This can't be changed by the General Assembly or put in place locally. The process is dictated by the Tennessee Constitution. Begin the Gerrymandering Wars.
There may not be enough time to make the new District Map because no matter how you slice the pie someone gets upset. The people of Farragut have cast the first blow. Sequoyah Hills will be next. And it will never end.
How about that Baker Center? They did a bang up job didn't they? Good with statistics not so good with common sense.
But a few people warned this would happen. It must be satisfying for them.
The highlight of this YouTube is where Commissioner Briggs invites anarchy by saying anyone can draw up the new District maps.
I sense a disturbance in the farce. This will dwarf Black Wednesday in both entertainment value and wasted time.
The sad part is we the taxpayers get to pay for each lawsuit. Hopefully Chancellor Moyers will end this for the benefit of all of us. He has the authority to make this go away.

1) The discussion of which districts pay the most in property taxes was just offensive. The last time I checked it was one person, one vote - not one tax dollar, one vote.
2) Dr. Briggs says he is "there" (on Commission) to represent Farragut. Oh really? For some odd reason, I thought he represented the entire 5th district. Reminds me of Howard Pinkston saying once that he represented the interests of south Knox County outside the city limits.
3) Dr. Briggs didn't "invite" anybody to draw maps. The committee has said it will look at maps from citizens if they want to submit them.
4) I don't know how Dr. Briggs "knows" what is going to happen, since the committee has yet to develop a proposal.

No one will be happy with the results. Everyone will want to gerrymander to keep their District the way it is. One big fight.
Farragut will be divided in half. Nothing can stop that. Sequoyah Hills will be in the 9th District. Nothing can stop that. The math on this is simple. District five has to be cut up. Sequoyah Hills is a rock in a hard place.
The funny part is Farragut and Sequoyah Hills are the two places that put Charter Amendment three over the top. Now they are the two most angry Districts.
They just didn't think about what they were voting on. The KNS supported the Amendment and just didn't report the consequences. All people thought about was ending nepotism.
This is what you get with combined Charter Amendments. But it was shinny.

I don't know how you can be 100% positive of anything in Knox County.
The two scenarios above are probable because of the math. I don't see Farragut not being split. The math almost certainly guarantees it. You have to do some pretty tortured stuff not to split Farragut. Commissioner Briggs in the YouTube suggested one way to draw the Districts that doesn't split Farragut. It is highly unlikely that plan even with great political pressure would ever be approved.
Commissioner Briggs is wise to deal with this now as he and Mike Hammond approved both Charter Amendments before Election Day. Commissioner Briggs even had a guest editorial in the KNS lauding Charter Amendment 3.

Any move made will upset people. But the 5th District has to cast off a lot of people. It has to be divided some way. No matter how the pie is divided people will be mad and will remember in the next Election.
As for Sequoyah Hills, the problems are the same. What other District could it be in? In many ways you have to start in the 5th and make a decision. Then move either clockwise or counter clockwise. Try it. No matter what you do it creates an unpleasant outcome.
This is the mother of unintended consequences. But it was pointed out this would happen. 48.5% of the voters figured it out. Maybe giving this Amendment extra time in the petition counting process wasn't such a bright idea after all? Maybe writing guest editorials lauding Charter Amendment 3 wasn't such a great idea?

You have to start in the 5th and split it up somehow. The Cedar Bluff split to the 6th doesn't work. It is straight up gerrymandering to keep the Farragut people happy. Split Farragut and Sequoyah Hills goes into the 9th. Again, that is the math.
So it is simple, can some greasy political way be found to put Cedar Bluff in the 6th? Of course, this is Scruffyville. But the math doesn't work.

Anything is possible is this scruffy little place. There really isn't law as much as there is interpretation of what the law used to be.
But I don't think the Cedar Bluff split can be approved. It causes problems with federal law in the 1st. It is a domino effect. Each shift affects each District. It is not as easy as it sounds.
Too some extent I find this funny. Except for the wasted time and taxpayer money. Even more funny is the rumor that Gary Drinnen will be the replacement for Greg Mackay. Is Big Jim the decider? I would think the new Director of Elections should not be someone who was a front man for KCP. But that is just me.

That was a uncharacteristic hoof and mouth moment. You are correct. One person, one vote.
There were at least two other hoof and mouth moments in the 9 minute presentation by Commissioner Briggs. Suggesting that the Cedar Bluff area was more like District 6 won't sell well as that suggests District 6 isn't good enough to have Farragut in it. That was cringe worthy. When you are in a hole the best advice is to stop digging.

What does that mean? The census redistricting was based on 9 Districts. How would there be a fight? It is changing to 11 Districts that creates the nightmare.
BTW, don't be too concerned. Ironically Charter Amendments 1 and 2 will void Charter Amendment 3 in a court challenge. Charter Amendment 1 has 9 Districts. Charter Amendment 2 has 9 Districts. Both Amendments were approved by Commission and certified by the Election Commission before Charter Amendment 3. Then they were voted in by the voters.
Charter Amendment 3 did not include controlling language on the number of Districts from Charter Amendments 1 and 2. It is only a matter of time before this goes to court and Charter Amendment 3 is voided by the court. You leave out the controlling language and you lose. The Charter Petition people were incompetent in drafting their Amendments.
The real nightmare potentially is that if that ruling striking down Charter Amendment 3 was appealed the 2010 Election might come up and have to have 11 Districts only to be later be returned to 9 Districts. Sound familiar? So just like the musical chairs we have suffered through in County Commission we could do that with redistricting. There should be only one redistricting, for the census. We may have three redistrictings.
At some point people will lose their patience with this idiocy. The best thing for everyone is for Charter Amendment 3 to be struck down and stay down. Compared to Shelby County we don't look so good. All of this brings a good question, is this Charter worth keeping?

Redistricting is still necessary in order to make 9 roughly equal sized districts - the 5th has been bigger (in population), and so has had 3 commissioners instead of 2 like the rest.
And SnM is correct - we will have to redistrict again in 2011 because of the new census. Affected politicians were gonna scream then anyway.

Tune into County Commission on Monday if you haven't figured it out. The man will say anything. How can someone try both sides of a case? McAdams conduct on Charter Amendment 4 makes no sense. First he tells those people to collect petitions. Then he says they didn't have to. When was the man right?
Simple question, what does the word "create" mean? McAdams/Briggs says that the Charter Review Committee of 2006 created the Sheriff's Department and the Fee Offices. The minutes of that committee show that to be untrue.

Situational ethics are not ethics of any form. At the threshold of 14,000 signatures a petition for a Charter Amendment to throw away this Charter is not difficult at all. A few weekends in North Knox County would do the trick. After the redistricting nightmare the voters may well be ready to can the Charter. McAdams hurts the people he tries to help. So does Briggs. It most certainly does have to do with this redistricting.
Charter Amendment 3 is illegal on so many counts. Multiple T.C.A. conflicts, multiple County Charter conflicts, multiple Charter Amendment conflicts, multiple Election Commission violations. Legal interpretations from fantasy land.
Why must we keep playing musical chairs only to return to the original position? Charter Amendment 3 was one of the worst most poorly written Amendments in county history.
Do you really believe people will just turn their heads and look away? Now that people see how it will affect them, the gloves are off. Farragut and Sequoyah Hills have some clout. There were fooled and now they are mad.
Why can't it just be done straight up?

Thank you Rachel for clarification! As I was reading through these posts, I thought I was missing something... Charter Amendment 3 simply reduced the number of district commission representatives by 1/2. As I read it, and from watching Dr. Briggs' YouTube video, the redistricting is based on census data - has nothing to do with the Charter Amendment.
At some point, as a city continues to grow - uh... sprawl - redistricting is a matter of course. It's always going to be controversial to those affected by the redistricting.
I'm a South Knoxville resident and can certainly understand Sequoyah Hills' concern with being redistricted with SoKnox... our issues here are totally different than their issues. It will be a challenge for the district 9 commissioner to make sure s/he is representing both areas.

1) The discussion of which districts pay the most in property taxes was just offensive. The last time I checked it was one person, one vote - not one tax dollar, one vote.
The Baker Center didn't do anyone any favors with their little study that spawned Charter Amendment 3.

5th District Commissioner Richard Briggs said:
“On the November ballot, there was an item that was passed that will reduce the size of County Commission from 19 Commissioners to 11 Commissioners,” Briggs said.
“The reason this concerns Farragut is that, in the past, we’ve had three Commissioners and have been roughly a third larger than any other districts,” he added.
In order to balance the population in each of the new districts, certain precincts within the 5th district will have to be moved to another district. Knox County Election Commission has requested precincts be moved between districts as whole parts. Farragut is separated into two precincts, 66 North and 66 South.
“One of the plans will take the 66 North, that’s the Farragut north district, and move that to the 6th district. That would mean half of Farragut would be in the 5th district and half would be in the 6th,” Briggs said.
The 6th district includes parts of Hardin Valley and continues to Lovell Road, Hall Road, Callahan Drive, Clinton Highway and Emory Road to Powell. The 6th district commissioners are Greg “Lumpy” Lambert and Brad Anders.
“It seems to me, what this may do is dilute Farragut’s voice at the County level. Farragut pays an awful lot of taxes to the County and … I think we deserve to have a say,” Briggs said.

Most people, nay, most eligible voters live life quite perfectly happy without even paying any attention to what we discuss about local politics here, or anywhere else for that matter.
And as long as the trash is picked up, the schools function, and the police protect, I doubt they're going to care or act.
It's like the human body. I don't have to know how every cell functions or fails to function, as long as it pretty much works. That's how most voters operate.
That may outrage some,and satisfy others, but it really doesn't matter, because it's just what we do.

As has been pointed out numerous times, the only way Charter Amendment 3 affects redisctricting is that it is required earlier than what was anticipated.
There will be 9 districts, not 11. The 5th district will be divided somehow. That probably would have happened two years from now as well.
There are plenty of ways to look at dividing 5 without dividing the town of Farragut. What seems mathematically impossible is keep Cedar Bluff and Farragut in the same district.
Sequoyah Hill is on the far eastern edge of a district that runs all the way to Bluegrass. Its going to be interesting to see what happens to that whole district. Putting 24-Q into the 9th doesn't make much sense. It seems to me that starting in the 9th and moving towards the 8th would create a more contiguous district. However, I'm not on the committe, nor do I have the psychic abilities of #9.
All of this conjecture with no basis in fact only serves to purposefully piss people off. We'll all have plenty of time to review the committee's actual proposals soon enough.

Redistricting
As I understand it from what David Buuck has filed, there are at least two issues related to redistricting here. First argument is that by creating two at-large countywide commissioners, you are actually creating an additional "superdistrict" that covers the entire county. The two countywide commissioners will, in effect, be representing more voters than the other nine districts, a probable violation of federal election law.
The city has two at-large citywide council members, but with one very important difference: all voters can vote for all council members in every district. Therefore, no one councilperson has any more "voter power" than any other councilperson, even the "at large" representatives.
The second issue is related to the first. By creating two additional commissioners who are countywide, you are denying effective minority representation by diluting their votes.
The redistricting issue itself (whether caused by Charter Amendment 3 or by the new census) is going to be very challenging and problematic as they try to maintain minority representation for a population that has really spread out through the county.

It is a District. The McAdams ploy of calling it a seat is just semantics to not violate both T.C.A. and federal election law.
This entire Charter Amendment 3 is a fraud. There are so many holes and legal violations that it is difficult to believe that people would play the McAdams word game.
But those people do exist.
McAdams should have to compensate Knox County for all the litigation he has created. If you remember someone went after Herb much the same way.
Tomorrow is another day in McAdams land. If Commissioner Briggs is successful Monday there will be more lawsuits. This anarchy is getting expensive.
