A source tipped us that several of Knox Co. Mayor Tim Burchett's internet domain name registrations expired recently and were snatched up by Brian Hornback.
In addition to timburchett.com, it appears electburchett.com, timburchett.info and timburchett.org were also grabbed around the same time, presumably also by Brian Hornback. Electburchett.com and timburchett.org both redirect to brianhornback.com. Timburchett.info is parked.
If Tim Burchett decides to run for another office, it appears Brian Hornback holds the keys to his online presence. Too funny.

Not saying it applies here, seems like a gray area with the other provisions and qualifiers. Maybe Burchett doesn't care, otherwise they should just work it out and move on.

But it is not a mark of trade and trademark law would supersede this law. Having applied for a trademark, the paperwork to PROVE that you are not trying to mark your own name is 3 pages alone plus two affidavits. Any decent lawyer would get it tossed in preliminary arguments.
There would be no reasonable person who would think that Tim Burchett has become Brian Hornback. He probably shouldn't have pointed them at anything other than a parked page or satire. Still buying up domain names and pointing them at rivals' websites has become regular sport at the national stage and I'd be a dollar to a donut that Timmeh would have to demonstrate that his name is so distinct as to be diminished by this kerfluffle. I agree with Hornback that if the dude can't register a domain name permanently, then he's not big on details.

Burchette probably wouldn't buy any advertising on the website so he'll have to pay a licensing fee to use one of the historical web domains.

The Moral Majority
I lived in Hawaii in the 1980's when it was announced that Jerry Falwell would be bringing his movement to the islands to enlighten us. Before he arrived some dude copyrighted the trademark Moral Majority, forcing Falwell to abandon his moniker for the duration of his stay. We loved it.

I don't recall that Falwell's organization ever successfully challenged this and I don't remember hearing about the local Moral Majority again. I think its real intent was to blunt any influence Falwell might have during the few weeks he was in Hawaii and to one-up him in a very public way. It worked.
