You may have heard that TVA is asking, by way of Rep. Wamp and Rep. Davis, for "stimulus" money to clean up the Kingston Swan Pond ash spill. That's not what "stimulus" money is for and this is a ridiculous request.

Regardless, Southern Beale has a good question: Where's the EPA Superfund? This situation is exactly what it's for.

Under the auspices of CERCLA, it has to be added to the NPL (National Priorities List) first.

Current TN list here.

(And as you probably can expect, the Superfund isn't so super when it comes to being funded.)

I think Superfund is

I think Superfund is intended mainly for legacy polluters who are defunct or where there is little chance of recovering cleanup costs from whoever made the mess. So unless TVA starts transferring assets into its wife's name or seeks to reincorporate as Tennessee Valley Amalgamated, the Swan Pond avalanche probably won't qualify.

Correct.

SF was intended to fill the gap where it was difficult to trace the pollution of a site to a particular owner (for example, multiple companies owning a plan over a period of decades), or the original polluter no longer being in business. Superfund wouldn't apply here.

I don't see the Kingston cleanup as being an "infrastructure" task, unless it's going to take 20 years to clean up. Now, supporting reconstruction and reinforcement of coal retention ponds around the country, perhaps.

Just a clarification,

Just a clarification, superfund sites are not limited to properies that have been abandoned. Several sites around the country still have the active parties present. Some examples include the lower duwamish waterway in seattle, Porland harbor in Oregon, and Hanford in eastern Washington. Although many of you are correct, this site would have to be added to the npl, before they could receive any funds.
