Scott Emge, who ran a successful primary campaign to oppose term-limited Register of Deeds Steve Hall in the general election, has issued a press release calling the term limits ruling "a victory for Knox County voters."
Scott also says "One thing that I’m afraid of is that these positions will be filled with cronies, friends or family members through backroom deals rather than people who legally qualified, ran campaigns, and received thousands of votes from the people of Knox County."
Scott argues that the candidates who received the second highest number of votes in the last general election should be appointed to fill the vacancies until an election can be held.
That's an interesting argument, given that the Tennessee Supreme Court has ruled that their term-limited opponents are not qualified to hold office, raising the question as to whether they were qualified to be on the ballot in the first place. The ruling does not explicitly say it is retroactive to election day, but I suppose one could argue that it is.

Register of Deeds Candidate Asks County Commission “Don’t Disenfranchise Knox County Voters”.
Scott Emge, last year’s candidate for Knox County Register of Deeds, said that the recent ruling handed down from the State Supreme Court was a victory for Knox County voters.
“This ruling also vindicates me and all the other candidates who campaigned last year on the term limits issue”. He goes on to say, “The courts’ ruling was fair and just. A special election is the best way to fill the vacancies long term and should be carried out during the 2008 election cycle. In the meantime, Knox County Commission is required by law to fill those vacancies as quickly as possible”. Emge says “One thing that I’m afraid of is that these positions will be filled with cronies, friends or family members through backroom deals rather than people who legally qualified, ran campaigns, and received thousands of votes from the people of Knox County.
The Knox County Commission should follow the State Supreme Court’s example and let the will of the voters rule in choosing the replacements for the vacancies. Candidates who ran against these ousted office holders and received the next highest vote totals from the general election should be chosen to fill the slots. 15,332 voters chose me for Register of Deeds, 23,134 folks chose Randy Tyree for Sheriff, 3,458 chose Tom Salter for 5th Dist C, 2,591 wanted Elaine Davis for 4rth Dist. B, 780 for Amy Broyles 2nd Dist. A, 682 for Nick Della Volpe 1st Dist. A, among others. With all due respect to the county commission, all these votes total a lot more than any the commission can cast, and if they ignore these numbers they will be disenfranchising tens of thousands of Knox County Voters” Emge said.
There have been valid concerns expressed by some on the county commission that hourly employees that work hard every day in the fee offices might lose their jobs. “It would be not only wrong but ridiculous to let any of these hard working folks go. They are the ones doing all of the work in these offices and making sure that things get done. I know I wouldn’t fire anyone in the Register’s office who is doing the county’s work” Emge said.

Finally a voice of reason
I have been waiting for someone to bring up this idea.
The people who ran against these term-limited candidates put in a lot of time and money to prove they were interested and right for the jobs.
To appoint others who showed no interest in the positions would be not only unfair but also undemocratic.

Call Your County Commissioner!
I encourage everyone to flood their county commissioners with calls demanding that these qualified candidates be chosen as replacements. These runner up candidates were in fact the only legally qualified candidates to be on the ballot in their respective races...the State Supreme Court has just proven that fact. Call your commissioners!
But Scott, you're being pretty selective here--
Leaving aside the fact that there's no legal or historical precedent for awarding an elected office to the candidate who came in second, what about the other runners-up? Would you support appointing candidates like Chuck James, the Democrat-turned-Republican who came in second to Mark Cawood in the general election? What about Tom Pressley, the Democrat who opposed John Mills?
One problem with that would be that Republican Kay Frazier probably got more votes in the primary than Presley got in the general. Would that make her the real runner-up? I understand Republican Mike Alford claims he likewise got more votes in the primary than Schmid's Democratic opponent got in the general, as well (I haven't looked these two up).
If you are serious about proposing this, you need to be consistent.

No matter if someone got more votes in a primary than another got in the general election, the term-limited people knew their run might not be legal and so did their party. People voted for them knowing they might not be legal candidates.
Now that it did not turn out their way they cry foul. Sorry, I think this way is fair and democratic.

Basically my point is this, these term limited candidates knew they weren't supposed to run. They were relying on us voters to forget all about the term limits law. Legally, they were not qualified to even be on the ballot and this point was proven by Friday's court decision. I don't think the county commission should arbitrarily vote in replacements who did not qualify, campaign, spend their money or time to get the jobs. Am I wasting my breath? Probably. Replacements will most likely be cronies, flunkies, or family members. Business as usual in Knox County.

You and I both know you are right, sadly.
How about this?
In any races that were contested last year, the county commission's consideration should be limited to only the candidates that legally qualified and ran against a term limited incumbent. If there was a primary challenger (who lost to the term limited incumbent) and a general election challenger, let the commission choose between these through vote totals, interviews, resumes, etc.... In races where a term limited incumbent was unopposed in the primary and general election, it would be at the commission's discretion who to choose to fill the opening.
I think this would be a much better and fair way to handle the situation, eliminating the chance of the open positions being rewarded as payback to friends and family through back room dealing.

I agree with Scott1202. The only people who should be in consideration for an opening should be the people who were on the ballot legally for the various offices. If all these people who are now kissing the asses of the county commissioners to get the jobs really wanted them, they should have filled out and turned in qualifying petitions, campaigned and worked like all the other legal candidates.
