In today’s News Sentinel an article by Matt Lakin quotes Knox County Sheriff Tim Hutchison as saying that a law was broken in the theft of emails from former Knox GOP Chairman Chad Tindell.
Terry Frank informs readers of her blog that two local radio hosts who were subjected to Team Ragsdale dirty tricks have written a letter to Knox County Commission. Lloyd Daugherty and Kelvin Moxley tell of how Tyler Harber went to the Knox County Health Department and attempted to obtain their medical records.
Betty Bean spoke this morning on the Lloyd Daugherty radio program on AM 1180 that former GOP head Chad Tindell was threatened by Mike Arms, Chief of Staff to County Mayor Mike Ragsdale.
Did Mike Arms use the threat of publishing the Tindell emails to pressure Chad Tindell to allow the statue of limitations to lapse in regard to prosecution of Tyler Harber for hacking his computer and stealing his personal emails?
If so, would this be an indictable crime?
Team Ragsdale has repeatedly used some variation of the following pass the buck defense: "The district attorney general, who is the highest law enforcement authority in the county, has reviewed this matter repeatedly and found nothing wrong. This is nothing more than political shenanigans, and I look forward to speaking directly to the real motives behind this on Monday."
Will DA Randy Nichols review this new allegation?
Reportedly there will be a column in the News Sentinel Tuesday about the Mike Arms Chad Tindell blackmail story.
The County Commission meeting will begin at 2:00 PM today and will be televised on Knoxville Community Television. For Comcast Cable it is on Channel 12 and for Charter Cable it is on Channel 6.

My understanding is that the Sheriff has a thick file on this matter but due to Randy Nichols decision not to proceed, the information in that file cannot be released to the public, or to the County Commission.
Tomorrow the News Sentinel will print the Chad Tindell side of this story. A day late as usual. It is very possible that County Commission will defer this vote today for an investigation for one month as new information has just become known this morning.
Mr. Nichols, are you sure you have made the right decision?

I encourage you to modify this accusation I repeatedly hear thrown around about an attempt to access "health records" of Doughtery and Moxley.
Suggesting the Health Dept. would even entertain such a request to break security with individual health records taints their integrity and is inflammatory to the citizens of our county.
A more realistic allegation is that the (public) records of TennCare enrollees were accessed to be searched for political purposes. I think it is much more likely and still along the same line of ethically questionable behavior. There could even be some trail of routine paperwork if such access is requested, that may be worth pursuing. Could a county employee there possibly remember the episode? Another possibility.

I'm way behind the curve on this one. This affidavit confirms enough on this issue to recommend the need for an ethics investigation at minimum.
Still worth pointing out that we're talking TennCare enrollee records here, not actual health records of individuals...
And Mark Jones understandings to know the "public" rights to access to TennCare rolls is likey something he never encountered until this episode. He states uncertainty at one point, and then implies that they are "not" later on. The authority on this is not cited, but I assume it's under the purview of the state.
Ragsdale Is Taking Pages From Clinton Playbook

Ragsdale thinks he is Clintonesque and when it comes to government ethics and elected paranoia he's not only Clintonesque, hell he's a Nixonian and perhaps needs psychological help with the fear that somebody's out to get him. The only person out to get Mike Ragsdale is Mike Ragsdale and everybody else could really careless.
If he worked half as hard at building schools and funding the properly as he has with the defesense of HarberGate, the Hardin Valley High School would already be up and running, with students and teachers in place.

In the Mark Jones affidavit, Jones is the head of the Knox County Health Department, it is clear that Tyler Harber did attempt to obtain Lloyd Daugherty and Kelvin Moxley's medical records. Jones has sworn Harber did not obtain those records. Jones also stated that he had no knowledge whether Mike Ragsdale or Mike Arms were aware of Tyler Harber's effort to obtain these medical records.
You raise a valid point however, this is no way should reflect upon Mark Jones or the Knox County Health Department. The important question is what did Mike Ragsdale know and when did he know it? Hence the need for an investigation.

It is complex. First Mike Hammond moves to remove the resolution for an investigation from the agenda. I did not note who made the second.
Then a move to call the question was made which means there will be no debate and the vote must occur immediately. I did not note who made that motion.
John Griess corrected the Law Director John Owings on the fact that 13 votes were required instead of ten votes as the Law Director had ruled for the motion to remove the resolution.
Commission is now in a five minute break that has lasted over 15 minutes. Lumpy Lambert wanted to talk with the people in the audience who came to speak. They are obviously very upset.
Then the Commissioners broke off into different camps to discuss matters.
It is a tense situation.

Lumpy Lambert moved to withdraw the 903 Resolution for an investigation of Tyler Harber.
Mike Hammond offered to withdraw his motion to remove the 903 resolution from the agenda.
Applause from somewhere, I could not tell if it was from the audience.
Having watched many of these meetings this was unique. It was very strange from the beginning. A political passion play.
It would be interesting to hear from someone that was in the room. I would like to know where the applause came from.

Apparently there were not the magic 13 votes for the investigation, so rather than let team Ragsdale look victorious, they withdrew the item. We will see more tonight on the news, they were all there with cameras interviewing Lumpy.

It was a chess game of the Knox County Charter. Had Mike Hammond prevailed with his resolution to remove the 903 resolution from the agenda it could not come before Knox County Commission for 90 days.
When Lumpy Lambert asked for the five minute recess he asked for advice. The advice was to withdraw the 903 resolution and the result is that it can be placed on next months agenda.
I thought this might happen. Tomorrows News Sentinel article may be the straw that breaks the camels back. Judging from what I heard on the radio this morning from Chad Tindell there is trouble on the way for both Mike Arms and Mike Ragsdale. I wish I could provide a way for people to hear what I heard on the radio, it sounded to me as the pressure exerted by Mike Arms on Chad Tindell would have broken several laws. The News Sentinel has an article on this Chad Tindell Mike Arms event that could not meet the deadline for Monday publication. It supposedly will be in print on Tuesday.
I did find out where the applause came from after the 903 resolution was withdrawn. It was from the audience. Mike Ragsdale had about two dozen people, county employees, who applauded when the resolution was withdrawn. Apparently they are not knowledgeable with the Knox County Charter.
Yet the most interesting part of the meeting had not occurred yet. A Vietnam veteran came to speak in the Public Forum. He first asked for a moment of silence for the veterans of both Vietnam and the two Iraq Wars. Then he told the County Commission that he had been personally attack on a guestbook, the AM 1180 guestbook/blog, by anonymous persons who claimed he had a dishonorable discharge from the military. He presented his Honorable Discharge papers and held them very close to Mike Arms' face. He spoke eloquently about how we are fortunate to live in a place where free speech is possible and spoke that no government should attack private citizens. You got the feeling he was sending a message to Mike Arms.
After the Public Forum Scott Moore challenged Mike Arms about a threat in Todd Cooks sworn affidavit. He asked Arms which County Commissioner had threatened Todd Cook with his job unless he hired family members of the unknown Commissioner. Arms said he knew nothing other than his own affidavit and suggested Chairman Moore ask Todd Cook himself. Scott Moore instructed Arms to find out who the Commissioner was and to notify County Commission. Arms looked pale and very uncomfortable.
Both Betty Bean and Frank Cagle where in the meeting. I look forward to their reports.
This is a mess. It would seem that the best course of action is for a Grand Jury from another East Tennessee County to investigate this matter. But I learned that when a close relative, don't ask, of Mike Ragsdale received a DUI he was tried by the DA in Washington County. This is the same DA that will try Jay Witt. That would not be a good choice for the potential Grand Jury.
Perhaps the TBI should step in. In 16 years of Victor Ashe we never had these kinds of problems. If that is not enough news for one day, Jay Witt's bond has been revoked.

How can facts not be true? If something is a fact is it not true by the definition of being a fact? The babble that comes from this political machine is simultaneously sad and comical. Very comical.
The other thing that bothers me is that Mayor Ragsdale has much kinder things to say to Tyler Harber than he does to Betty Bean. What does that say about Mayor Ragsdale?

As county mayor, he has done virtually nothing to speak of (except raise taxes) and nothing that would allow him to have any respectable chance of running for governor in 2010. Zach Wamp will have run 2 successful congressional campaigns and the chance to face off for the open seat will fall in his lap. Perhaps sound bite Mike should look at Jimmy Duncan's seat, he's only sitting there in the event one of his kids would like to take it, he get's no glory going back and forth to Washington and getting no committee assignments, no invites to the Republican events, and no perks nor benefits whatsoever.

Why is everyone so afraid of this little man. My little girl could lay Ragsdale out with one punch and she ins't even in high school. Does he have a file on everyone in government? All he and his thug Mike Arms do is bully and threaten people. I am sick of it and it looks like I am not alone. I see why people like Number9 stay anonymous. Keep up the reports. Maybe some other people will see what a bad apple this guy and his thugs are.
