Boo! Remember, according to the 2001 line of reasoning, they did this because they hate our values as Americans. Remember 2001? Oh, yeah. Back then! Well, everything is different now. They are murderers. Murder is a crime. Crimes are tried in criminal courts. That's an American value. If you aren't down with that, then just isn't any hope for this country. But our media will never process that syllogism. Why? It's too, um, difficult?

Please spare us talk of the "rule of law." If that was the primary consideration, the U.S. already has a judicial process in place. The current special military tribunals were created by the 2006 Military Commissions Act, which was adopted with bipartisan Congressional support after the Supreme Court's Hamdan decision obliged the executive and legislative branches to approve a detailed plan to prosecute the illegal "enemy combatants" captured since 9/11.

Contrary to liberal myth, military tribunals aren't a break with 200-plus years of American jurisprudence. Eight Nazis who snuck into the U.S. in June 1942 were tried by a similar court and most were hanged within two months. Before the Obama Administration stopped all proceedings earlier this year pending yesterday's decision, the tribunals at Gitmo had earned a reputation for fairness and independence.

My response is you seem to not understand our Constitution. Our modern day justice system has little to do with the Constitution. The Constitution isn't the problem. It is those current justices who ignore it and modify it from the bench.

Military Tribunals are well established. That is part of what you refer to as "our justice system". What Eric Holder did is unconscionable. Why didn't President Obama intervene?

This is simple. Do you want to allow terrorists to escape Military Tribunals and bankrupt local and state governments with criminal trials? That is a form of terrorism.

That ship has sailed. Holder can't go back now. I don't understand why there were not military tribunals long before this. I don't know why Bush didn't deal with this.

I don't understand Holder. How do you go from non-uniformed enemy combatant to a criminal trial. Where is water boarding in Miranda? It would seem any decent attorney could get KSM off. This decision is inexplicable.

What Bush was waiting for was these cases to be before military tribunals under a different President, because, as evidenced by the general pissed-offed-ness of the miltary judges at the human rights violations against these criminals under the terrorist actions of Cheney, et al, he didn't want these criminals to, well, get away with it under his watch.
