Boo! Remember, according to the 2001 line of reasoning, they did this because they hate our values as Americans. Remember 2001? Oh, yeah. Back then! Well, everything is different now. They are murderers. Murder is a crime. Crimes are tried in criminal courts. That's an American value. If you aren't down with that, then just isn't any hope for this country. But our media will never process that syllogism. Why? It's too, um, difficult?
But then Jon Stewart has already covered this:

yup
So sad and so true.
Our media.
And that it takes a comedian to point it out just proves the point.

... $75 million in extra security costs related to the terror trials.
Yikes!
logic is your friend
They are murderers. Murder is a crime. Crimes are tried in criminal courts.
Fascinating. Along that line of logic when will we see the civil trial for the property damage of the World Trade Center and the 3,700 plus wrongful death law suits?
It is almost as you have channeled the thoughts of thousands of lawyers. Maybe this is how Bin Laden will overthrow the great Satan. With an army of lawyers. Might work. It is certainly simple enough.
Scaredy cat. Boo. Boo. Boo.
Scaredy cat. Boo. Boo. Boo. Boogerman is gonna get you. Boo. EEEEEEEK.
BTW, the 9/11 victims compensation fund indemnified all potential non-mass murdering fuckheads from suit when victims' families took money. You should know that, but, well, you don't know much.

Your logic is flawed.
Was 9/11 an act of War? Or just some heavy duty vandalism? I don't recall trying the Japanese in criminal court for Pearl Harbor.
This may be Obama's plan to save the newspaper industry and MSNBC. If you liked the OJ trial, you'll love this farce.
The sad part is this enables terrorism and places everyone in harms way.

What nation or nations declared war on the U.S.? What flag did they fly? What uniform did they wear? Who do we accept terms of surrender from? When did U.S. Congress declare war?

You make a strong point as to why no enemy should ever wear a uniform. Hence the term enabling.

Please spare us talk of the "rule of law." If that was the primary consideration, the U.S. already has a judicial process in place. The current special military tribunals were created by the 2006 Military Commissions Act, which was adopted with bipartisan Congressional support after the Supreme Court's Hamdan decision obliged the executive and legislative branches to approve a detailed plan to prosecute the illegal "enemy combatants" captured since 9/11.
Contrary to liberal myth, military tribunals aren't a break with 200-plus years of American jurisprudence. Eight Nazis who snuck into the U.S. in June 1942 were tried by a similar court and most were hanged within two months. Before the Obama Administration stopped all proceedings earlier this year pending yesterday's decision, the tribunals at Gitmo had earned a reputation for fairness and independence.

Was the U.S.A. engaged in formal, declared shooting war with Japan before Pearl Harbor metulj?
FDR and Truman understood what it takes to defend a nation against maniacs. We sure could use some Democrats like that now. But this team is weaker than Carter. My advice, watch your six. Change this in 2010 and 2012. Damn right we need some change.

This was a crucially flawed and dangerous decision that has place millions of people in harms way across the world. It allows War without rules. It is the blueprint for never ending War.

This has been said by people
This has been said by people who said it a lot better than me, but the right-wing response to this whole thing is the very definition of letting the terrorists win.
Which should we do - cower in fear, or show the world we really believe in our justice system?
It's a no-brainer to me. (Cue #9 to deliver some sort of insult about my brain, or lack thereof.)
Which should we do - cower
Which should we do - cower in fear, or show the world we really believe in our justice system?
My response is you seem to not understand our Constitution. Our modern day justice system has little to do with the Constitution. The Constitution isn't the problem. It is those current justices who ignore it and modify it from the bench.
Military Tribunals are well established. That is part of what you refer to as "our justice system". What Eric Holder did is unconscionable. Why didn't President Obama intervene?
This is simple. Do you want to allow terrorists to escape Military Tribunals and bankrupt local and state governments with criminal trials? That is a form of terrorism.
So give them their military
So give them their military tribunals. What are we waiting for?
So give them their military
So give them their military tribunals. What are we waiting for?
That ship has sailed. Holder can't go back now. I don't understand why there were not military tribunals long before this. I don't know why Bush didn't deal with this.
I don't understand Holder. How do you go from non-uniformed enemy combatant to a criminal trial. Where is water boarding in Miranda? It would seem any decent attorney could get KSM off. This decision is inexplicable.
What Bush was waiting for
What Bush was waiting for was these cases to be before military tribunals under a different President, because, as evidenced by the general pissed-offed-ness of the miltary judges at the human rights violations against these criminals under the terrorist actions of Cheney, et al, he didn't want these criminals to, well, get away with it under his watch.
